    1. Acceptance of Terms

    By accessing or using GiftChit ("Platform," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Platform. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of any modifications.

    2. Eligibility

    To use GiftChit, you must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater). By registering, you represent and warrant that you meet this age requirement. GiftChit is void where prohibited by law. Employees of GiftChit, its affiliates, advertising and promotion agencies, and their immediate family members are not eligible to participate in sweepstakes.

    3. Account Registration

    You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

    Each individual may maintain only one (1) account. Creating multiple accounts to gain additional entries or circumvent limits will result in disqualification and permanent suspension.

    4. How GiftChit Works

    GiftChit is a free-to-enter sweepstakes platform. Users earn tickets by completing CPA (Cost Per Action) offers provided by third-party advertisers. Tickets are never sold or purchasable. Each ticket represents one entry into the applicable sweepstakes drawing.

    • Completing offers may require providing information to third-party advertisers.
    • Ticket quantities vary by offer and are clearly disclosed before completion.

    5. Provably Fair Draws

    All drawings are conducted using a provably fair system. A cryptographic seed is committed before the draw, and the full verification data is published after the draw concludes. You may independently verify any draw result using our verification tool.

    6. Prizes & Claims

    Prizes consist of gift cards as described in each drawing's details. Winners are notified via email and an in-platform notification. Winners must claim their prize within 72 hours of notification. Unclaimed prizes will be forfeited and may be re-awarded at our discretion.

    Winners may be required to provide valid identification and a completed affidavit of eligibility. Prizes are non-transferable and have no cash surrender value unless stated otherwise. Winners are solely responsible for all taxes and fees associated with prize receipt.

    7. Prohibited Conduct

    You agree not to:

    • Use bots, scripts, or automated tools to interact with the Platform.
    • Create multiple accounts or use false information.
    • Manipulate or attempt to manipulate drawing outcomes.
    • Complete offers fraudulently or without genuine engagement.
    • Harass, threaten, or abuse other users or GiftChit staff.
    • Reverse engineer, decompile, or disassemble any part of the Platform.
    • Use the Platform for any unlawful purpose.

    Violations may result in immediate account termination, forfeiture of tickets and prizes, and potential legal action.

    8. Intellectual Property

    All content on GiftChit — including but not limited to text, graphics, logos, software, and design — is the property of GiftChit or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

    9. Third-Party Offers & Links

    GiftChit facilitates access to offers provided by third-party advertisers. We do not control, endorse, or assume responsibility for the content, privacy policies, or practices of third-party services. Your interactions with third-party offers are governed by their respective terms and policies.

    10. Privacy

    Your use of GiftChit is also governed by our Privacy Policy. By using the Platform, you consent to the collection and use of your data as described therein. We will never sell your personal data to third parties for marketing purposes.

    11. Disclaimers

    GiftChit is provided on an "as-is" and "as-available" basis. We make no warranties, express or implied, regarding the Platform's reliability, accuracy, availability, or fitness for a particular purpose. We do not guarantee that the Platform will be uninterrupted or error-free.

    12. Limitation of Liability

    To the fullest extent permitted by law, GiftChit and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of data, revenue, or profits.

    13. Indemnification

    You agree to indemnify and hold harmless GiftChit and its affiliates from any claims, damages, or expenses arising from your violation of these Terms, your use of the Platform, or your violation of any rights of a third party.

    14. Termination

    We may suspend or terminate your account at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Any tickets or pending prizes associated with a terminated account are forfeited.

    15. Governing Law

    These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes shall be resolved in the state or federal courts located in Delaware.
